Terms and Conditions

QSoil is currently provided as beta software. This means:

• Features may be incomplete, may change, or may be removed at any time without notice.
• The Service may contain bugs, experience downtime, or lose data, and is provided without any guarantee of availability, reliability, or data durability.
• We recommend keeping your own copies of any critical data you enter, until the Service formally exits beta.
• We may end the beta program, or your access to it, at any time.

You must provide accurate information when creating an account and keep your login credentials confidential. You're responsible for all activity that occurs under your account.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Use automated means (scraping, bots) to access the Service without our prior written permission.

You retain ownership of the data, samples, photos, and other content you submit to QSoil ("Your Content"). By submitting Your Content, you grant SOILWATER a limited license to host, store, process, and display it solely to provide the Service to you and the other members of your locations. You're responsible for ensuring you have the right to submit Your Content and that it doesn't infringe on anyone else's rights.

Except for Your Content, all rights, title, and interest in and to QSoil — including its source code, software, design, user interface, graphics, logos, trademarks, and documentation (the "QSoil IP") — are owned by SOILWATER or its licensors.

Nothing forming part of the QSoil IP may be copied, reproduced, republished, distributed, publicly displayed, reverse-engineered, decompiled, or otherwise reused, in whole or in part, without SOILWATER's prior written permission. This restriction applies regardless of the Service's beta status.

We may suspend or terminate your access to the Service at any time, particularly during the beta period, including for violation of these Terms. You may stop using the Service and request deletion of your account at any time.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THIS APPLIES WITH PARTICULAR FORCE DURING THE BETA PERIOD DESCRIBED ABOVE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOILWATER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE.

These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-law principles. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the competent courts of the Netherlands.

We may update these Terms from time to time, particularly as the Service moves through and out of beta. We'll update the "Last updated" date above, and material changes will be communicated to active users where reasonably possible.
